Q420.  Will EPA be specifying an electronic submission format for facilities needing to notify EPA of delayed 2012 reporting under 98.3(b)(1)?


(1) For reporting year 2011, facilities with one or more of the subparts listed in paragraphs (b)(1)(i) through (b)(1)(xi) of this section and suppliers listed in paragraph (b)(1)(xii) of this section are required to submit their annual GHG report no later than September 28, 2012.  Facilities and suppliers that are submitting their second annual GHG report in 2012 and that are reporting on one or more subparts listed in paragraphs (b)(1)(i) through (b)(1)(xii) of this section must notify EPA by March 31, 2012 that they are not required to submit their annual GHG report until September 28, 2012.
A420. Yes. EPA will provide a mechanism within e-GGRT by which facilities can notify EPA that they intend to delay their reporting as allowable under §93.3(b)(1).   §93.3(b)(1) speciifes:

   i) Electronics Manufacturing (subpart I).
   ii) Fluorinated Gas Production (subpart L).
   iii) Magnesium Production (subpart T).
   iv) Petroleum and Natural Gas Systems (subpart W).
   v) Use of Electric Transmission and Distribution Equipment (subpart DD).
   vi) Underground Coal Mines (subpart FF).
   vii) Industrial Wastewater Treatment (subpart II).
   viii) Geologic Sequestration of Carbon Dioxide (subpart RR).
   ix) Manufacture of Electric Transmission and Distribution (subpart SS).
   x) Industrial Waste Landfills (subpart TT).
   xi) Injection of Carbon Dioxide (subpart UU).
   xii) Imports and Exports of Equipment Pre-charged with Fluorinated GHGs or Containing Fluorinated GHGs in Closed-cell Foams (subpart QQ)

Per §98.3(b)(4), since March 31, 2012 falls on a Saturday, the deadline for notifying EPA of the intention to delay submission of 2011 data is not due until the following business day, Monday, April 2, 2012.

As such this extension allows certain facilities to delay submission of their 2011 annual reports until September 28, 2012, provided a notification is submitted for each facility by April 2, 2012.

EPA is now completing its preliminary design for this feature but intends to provide a simple check box in Subpart A which facilities may use to notify EPA of their intent. This function will be available when e-GGRT is open for RY2011 GHG reporting in February of 2012, providing sufficient time to meet the 3/30/12 deadline.
