Q823. How TBDWho is eligible to discontinue complying with the GHGRP using the "offramp"?

 A823. TBD. 40 CFR Part 98.2(i) outlines the criteria for low-emitters to take the “offramp” to exit the program. A facility that has reported total GHG emissions below 15,000 metric tons of carbon dioxide equivalent (mtCO2e) for three consecutive years or below 25,000 mtCO2e for five consecutive years can discontinue reporting for all direct emitter subparts. For supplier subparts, the criteria apply instead toward reported GHG quantities supplied. These criteria apply to all subparts equally, including to subparts with no threshold (the “all-in” subparts) and to subparts with applicability thresholds that are different than 25,000 mtCO2e (such as subparts HH, DD, FF, and I). For example, an electricity generation facility covered only by subpart D that reports less than 15,000 mtCO2e in total non-biogenic emissions every year is eligible to discontinue complying with the GHGRP after submitting three consecutive annual reports demonstrating the low emissions.
